My domestic partner has died.  What do I need to do to terminate the Declaration of Domestic Partnership?

Shawn C. Newman

First let me offer my sympathies on the loss of your partner. Until this has happened to you, it is impossible to comprehend the loss.

Based on your question, I'm assuming that there is no additional estate administration work that you need to take care of with the loss of your partner – I'm assuming that other family members are accepting that role.  If not, you should probably consult with an attorney regarding your particular situation and what additional actions need to be done to settle your domestic partner's affairs.

The process for termination of the domestic partnership is very simple, and it does not differentiate between the death of a partner and the dissolution of the domestic partnership.

In both cases, you need to complete the form for termination of the domestic partnership and send it with a check for recording in the county where you reside. You should also record a copy of the death certificate for your partner as a public record. However, you may wish to check with any other family member performing the estate administration work as they may have already done this.

If you have additional questions, I think that you will find the recording clerks in your county to be sympathetic and help you file the correct forms for the termination of your domestic partnership.

Ask a Question

If you have a general question that you would like answered by a Florida Estate Planning and Administration Attorney, please use the contact form to send Shawn a question.   As long as it is general (and not too specific to your unique situation), Shawn will answer these questions in the form of a Frequently Asked Question to help you but also help others in our community.

Shawn can not offer legal advice in this format.   He can only provide general information that you may find helpful.  You should call an attorney and seek legal advice if you need specific legal advice.
